1. Introduction
This Warranty Policy explains how warranty claims are handled by MML Mining & Lubricants.
MML Mining & Lubricants supplies a wide range of PPE, safety equipment, industrial products, lubricants, tools, consumables, mining supplies, workwear, footwear, and related products.
Most products supplied by MML are sourced from third-party suppliers, distributors, importers, and manufacturers locally and internationally. MML does not manufacture most of the products it sells.
For this reason, warranty claims are generally subject to the warranty terms, inspection process, approval process, limitations, and exclusions of the relevant manufacturer, supplier, distributor, importer, or brand owner.
Nothing in this Warranty Policy is intended to remove or limit any customer rights that cannot legally be excluded under South African law.
2. Scope of this Warranty Policy
This Warranty Policy applies to goods supplied by MML Mining & Lubricants, including but not limited to:
Personal Protective Equipment
Safety footwear
Workwear and protective clothing
Gloves and hand protection
Head, eye, hearing, and respiratory protection
Industrial tools
Power tools
Lubricants, oils, grease, and related products
Mining and industrial consumables
Cleaning supplies
First aid products
Branded, printed, embroidered, or customised products
Special-order products
Any other products supplied by MML
This Warranty Policy must be read together with MML’s Terms and Conditions, Privacy Policy, Returns Policy, quotations, invoices, manufacturer documents, supplier documents, product instructions, and any applicable written agreement.
3. Manufacturer and Supplier Warranties
Where a product is covered by a manufacturer, supplier, distributor, importer, or brand warranty, that warranty will apply according to its own terms and conditions.
MML will, where reasonably possible, assist the customer by submitting or referring the warranty claim to the relevant supplier, manufacturer, distributor, importer, or brand representative.
MML does not control the outcome of third-party warranty assessments and is not responsible for delays, rejection, limitations, or conditions imposed by manufacturers or suppliers.
The final warranty decision may depend on the manufacturer’s or supplier’s inspection, testing, findings, policy, and warranty approval process.
4. No Automatic Warranty Approval by MML
Submitting a warranty claim to MML does not mean that the claim has been accepted or approved.
A warranty claim will only be accepted if:
The product falls within an applicable warranty period
The product qualifies under the relevant manufacturer or supplier warranty
The defect is not caused by misuse, abuse, negligence, poor maintenance, incorrect storage, incorrect application, or normal wear and tear
The claim is supported by proof of purchase
The product is made available for inspection where required
The manufacturer, supplier, distributor, importer, or MML approves the claim where applicable
MML reserves the right to reject any warranty claim that does not meet the requirements of this Warranty Policy, the applicable manufacturer warranty, supplier warranty, or South African law.
5. Warranty Claim Process
To submit a warranty claim, the customer must contact MML in writing and provide the following:
Customer name or company name
Contact details
Invoice number or proof of purchase
Product description
Product code or model number, where available
Date of purchase
Description of the alleged defect
Clear photographs or videos of the product and defect, where applicable
Details of how the product was used
Details of where the product was used
Any product serial number, batch number, expiry date, or manufacturing code, where applicable
Any other information requested by MML, the supplier, or the manufacturer
MML may require the customer to return the product for inspection.
No warranty claim will be processed without sufficient information and proof of purchase.
6. Inspection and Assessment
MML may inspect the product or refer the product to the relevant supplier, manufacturer, distributor, importer, or authorised technical representative for assessment.
The assessment may consider:
The condition of the product
The nature of the alleged defect
The age of the product
The date of purchase
The way the product was used
The application or environment in which the product was used
Maintenance history, where applicable
Storage conditions
Signs of misuse, abuse, contamination, alteration, or unauthorised repair
Manufacturer instructions and product specifications
Applicable warranty terms
MML may rely on the findings of the relevant supplier, manufacturer, distributor, importer, or technical representative.
7. Warranty Periods
Warranty periods vary depending on the product, brand, supplier, manufacturer, category, and type of goods.
MML does not guarantee that all products carry the same warranty period.
Some products may carry:
A manufacturer warranty
A supplier warranty
A limited warranty
A workmanship warranty
A usage-based warranty
A short-term warranty
No extended warranty beyond rights required by law
The customer is responsible for requesting warranty details before purchasing goods where warranty terms are important to the purchase decision.
8. Products Sourced Locally and Internationally
Many products supplied by MML are sourced from different suppliers, distributors, importers, and manufacturers in South Africa and internationally.
Because products may be sourced from different countries, warranty terms may differ by:
Brand
Product category
Supplier
Manufacturer
Country of origin
Importer terms
Product application
Product usage
Industry requirements
Batch or production run
MML will review the relevant warranty position for each claim based on the specific product supplied and the supplier or manufacturer involved.
9. Possible Warranty Remedies
Where a warranty claim is approved, the remedy may include one or more of the following, depending on the law, manufacturer policy, supplier policy, product type, and circumstances:
Repair of the product
Replacement of the product
Credit note
Refund
Replacement part
Manufacturer-approved remedy
Supplier-approved remedy
MML may not be able to offer a remedy before the product has been inspected and the claim has been approved.
Where the remedy is controlled by the manufacturer or supplier, MML may only be able to offer the remedy approved by that manufacturer or supplier, unless South African law requires otherwise.
10. What Is Not Covered
Unless required by law or expressly approved in writing, warranty claims will not cover defects, damage, failure, loss, or complaints caused by:
Normal wear and tear
Misuse or abuse
Negligence
Incorrect product selection
Incorrect sizing or fit
Incorrect application
Incorrect installation
Incorrect use
Poor maintenance
Lack of maintenance
Incorrect storage
Exposure to unsuitable conditions
Contamination
Chemical exposure
Heat, moisture, dust, corrosion, or environmental damage
Accidental damage
Intentional damage
Unauthorised repairs
Unauthorised modifications
Alteration of the product
Removal of serial numbers, labels, tags, seals, or identification marks
Use outside manufacturer specifications
Use outside intended purpose
Failure to follow manufacturer instructions
Continued use after a defect becomes visible
Damage after delivery or collection
Damage caused during customer transport, storage, or handling
Incorrect lubricant grade, specification, or compatibility
Mixing incompatible oils, grease, lubricants, or chemicals
Product expiry where the customer failed to use the product within the recommended period
11. PPE and Safety Equipment
PPE and safety equipment must be correctly selected, fitted, used, stored, inspected, maintained, and replaced.
Warranty claims on PPE may be rejected where the issue is caused by:
Normal wear and tear
Heavy-duty use
Incorrect sizing
Incorrect product selection
Incorrect storage
Contamination
Exposure to chemicals, heat, flame, moisture, or harsh conditions
Failure to follow manufacturer instructions
Continued use after damage
Use outside the product’s intended purpose
Failure to replace damaged or expired PPE
MML is not responsible for injury, loss, damage, downtime, or claims caused by incorrect PPE selection, incorrect PPE use, lack of training, poor maintenance, or failure to comply with workplace or mine safety requirements.
12. Lubricants, Oils, Grease, and Chemical-Related Products
Warranty claims relating to lubricants, oils, grease, or chemical-related products are subject to strict assessment.
The customer is responsible for confirming the correct grade, specification, application, compatibility, storage, and manufacturer requirements before use.
Warranty claims may be rejected where the issue is caused by:
Incorrect product selection
Incorrect product grade
Incorrect application
Incorrect storage
Mixing incompatible products
Contaminated containers
Contaminated equipment
Contamination during handling
Failure to follow manufacturer instructions
Use outside recommended specifications
Use in unsuitable machinery or equipment
Damage caused after delivery or collection
MML is not liable for equipment failure, downtime, production loss, contamination, or consequential damage caused by incorrect lubricant, oil, grease, or chemical use.
13. Tools, Equipment, and Power Tools
Warranty claims for tools, equipment, and power tools are subject to the relevant manufacturer or supplier warranty.
Warranty claims may be rejected where damage or failure is caused by:
Overloading
Incorrect use
Industrial use outside product rating
Poor maintenance
Incorrect power supply
Water damage
Dust or site damage
Accidental damage
Unauthorised repairs
Unauthorised modifications
Use of incorrect accessories or consumables
Failure to follow user manuals or safety instructions
Consumable parts are generally not covered unless the manufacturer or supplier confirms otherwise.
14. Branded, Printed, Embroidered, and Customised Products
Branded, printed, embroidered, altered, or customised products are subject to limited warranty coverage.
MML is not responsible for defects, dissatisfaction, or errors where the customer approved:
Artwork
Logo placement
Spelling
Colours
Sizing
Product choice
Branding method
Print method
Embroidery details
Layout
Quantity
Final proof
Warranty claims may be rejected where the issue results from customer-approved artwork, incorrect information supplied by the customer, unsuitable product selection, washing damage, misuse, or wear and tear.
15. Special Order Goods
Special Order Goods are sourced or supplied specifically for the customer.
Warranty claims for Special Order Goods are subject to the relevant manufacturer, supplier, importer, or distributor warranty.
Special Order Goods may not be returned, exchanged, refunded, or cancelled merely because the customer no longer wants the product, selected the wrong product, ordered the wrong size, changed requirements, or failed to confirm suitability before ordering.
This does not limit any rights the customer may have under applicable South African law for defective or unsafe goods.
16. Proof of Purchase Required
A valid proof of purchase is required for all warranty claims.
Proof of purchase may include:
MML invoice
MML receipt
MML order confirmation
Customer account record
Any other document accepted by MML
MML may reject a warranty claim where the customer cannot prove that the product was purchased from MML.
17. Return of Goods for Warranty Assessment
Where goods must be returned for warranty assessment, the customer must return the goods in a clean, safe, and complete condition.
The customer must ensure that goods returned for assessment are properly packed and protected during transport.
MML may refuse to accept goods that are unsafe, contaminated, hazardous, leaking, damaged in transit, incomplete, or not suitable for handling.
Where required, the customer must provide safety information, Safety Data Sheets, or handling instructions before returning goods.
18. Transport and Assessment Costs
Transport, courier, collection, or delivery costs relating to warranty claims may be handled according to the applicable manufacturer or supplier policy and applicable law.
Where a claim is rejected, the customer may be responsible for transport, courier, inspection, testing, repair quotation, storage, or return costs where permitted by law.
Where a claim is approved, transport or handling costs will be dealt with in accordance with the applicable warranty terms and South African law.
19. Turnaround Times
Warranty claim turnaround times are estimates only.
Warranty assessments may be delayed by:
Supplier response times
Manufacturer response times
Importer response times
Courier delays
Product testing requirements
Technical inspections
Availability of replacement parts
International supplier communication
Public holidays
Load shedding
Stock availability
Administrative requirements
MML is not liable for downtime, loss of income, loss of production, mine downtime, plant downtime, business interruption, or consequential loss caused by warranty assessment delays.
20. Rejected Warranty Claims
If a warranty claim is rejected, MML may inform the customer of the reason for rejection where such information is available.
Rejected goods must be collected by the customer or returned to the customer at the customer’s cost, where permitted by law.
MML may charge reasonable storage, handling, courier, or return costs for rejected claims where goods are not collected within a reasonable period after notification.
21. Limitation of Liability
To the maximum extent permitted by South African law, MML will not be liable for:
Indirect loss
Consequential loss
Loss of profit
Loss of income
Loss of production
Business interruption
Mine downtime
Plant downtime
Equipment damage caused by incorrect product use
Damage caused by incorrect product selection
Damage caused by misuse or abuse
Damage caused by poor maintenance
Damage caused by incorrect installation
Damage caused by unauthorised repairs or modifications
Delays caused by suppliers, manufacturers, importers, couriers, or warranty assessment processes
Where liability cannot legally be excluded, MML’s liability is limited, to the extent permitted by law, to the value of the goods giving rise to the claim.
Nothing in this Warranty Policy excludes or limits liability where South African law does not allow such exclusion or limitation.
22. Consumer Protection Act Rights
This Warranty Policy does not remove any rights that a customer may have under the Consumer Protection Act or any other applicable South African law.
Where the Consumer Protection Act applies, customers may have certain rights relating to goods that are defective, unsafe, or not of acceptable quality.
MML will handle such claims in accordance with applicable law, the facts of the claim, the product involved, the customer category, and the relevant manufacturer or supplier process.
23. Commercial, Industrial, and Mine Use
Many products supplied by MML are used in demanding commercial, industrial, construction, mining, workshop, factory, and site environments.
The customer is responsible for ensuring that the selected product is suitable for the intended environment and application.
Heavy-duty use, harsh environments, abrasive conditions, contamination, chemical exposure, heat, water, dust, pressure, incorrect storage, and abnormal operating conditions may reduce product lifespan and may affect warranty coverage.
MML does not guarantee that a product will be suitable for a specific mine, site, machine, project, job, or industrial application unless expressly confirmed in writing by MML.
24. Customer Duties
The customer must:
Check product suitability before purchase
Follow all manufacturer instructions
Use products only for their intended purpose
Store products correctly
Maintain products correctly
Inspect products before and during use
Stop using defective or damaged products immediately
Report defects promptly
Keep proof of purchase
Provide full information for warranty claims
Make goods available for inspection when required
Comply with workplace, mine, site, safety, and legal requirements
Failure to follow these duties may result in rejection of a warranty claim.
25. No Unauthorised Repairs or Modifications
The customer must not repair, alter, modify, dismantle, tamper with, or interfere with goods before submitting a warranty claim, unless authorised in writing by MML, the supplier, or the manufacturer.
Unauthorised repair, alteration, modification, dismantling, or tampering may void the warranty.
26. Final Warranty Decision
The final warranty decision may depend on:
The applicable manufacturer warranty
The applicable supplier warranty
The nature of the product
Inspection findings
Technical assessment
Product usage
Product condition
Proof of purchase
Applicable South African law
MML may rely on the decision, findings, or assessment of the relevant manufacturer, supplier, distributor, importer, or technical representative.
27. Changes to this Warranty Policy
MML may amend, update, replace, or revise this Warranty Policy at any time.
The latest version published on the website will apply from the date of publication.
Customers are responsible for reviewing this Warranty Policy before purchasing goods, submitting warranty claims, or relying on warranty coverage.
