9. Orders and Acceptance

10. Pricing
All prices are quoted in South African Rand unless stated otherwise.
Prices may change without prior notice due to supplier increases, exchange rate changes, fuel costs, import costs, transport charges, stock shortages, market conditions, or other business-related factors.

11. Payment

MML is not required to release goods or continue supply while payment is outstanding.
12. Ownership and Risk
Ownership of goods remains with MML until the full purchase price, including VAT, delivery charges, and any other applicable amounts, has been paid in full.
Risk in the goods passes to the customer when the goods are collected, delivered, handed to a courier, handed to a transport provider, or otherwise made available to the customer or the customer’s representative.
After risk has passed, the customer is responsible for insurance, safe handling, correct storage, security, and protection of the goods.
13. Delivery
Delivery dates and lead times are estimates only and are not guaranteed unless expressly confirmed in writing by MML.
MML is not liable for delay, loss, damage, or additional cost caused by:

The customer must inspect goods immediately upon delivery and report any visible damage, shortage, incorrect item, or delivery issue to MML as soon as reasonably possible.
14. Collection from Physical Shop or Collection Point
Where goods are collected by the customer, employee, contractor, courier, driver, or other representative, that person is deemed authorised to collect the goods on behalf of the customer.
The customer or representative must inspect the goods before leaving the collection point.
MML may reject claims for visible damage, incorrect quantities, missing items, or incorrect goods where such issue was not reported at the time of collection or within a reasonable time thereafter.
15. Mine, Site, Contractor, and SHE Requirements
Where goods are supplied or delivered to mines, industrial sites, construction sites, plants, factories, workshops, or controlled-access premises, the customer is responsible for providing all site access and compliance requirements before delivery or supply.

16. Product Suitability and Customer Responsibility
The customer is responsible for ensuring that goods purchased from MML are suitable for the customer’s intended purpose, workplace, industry, mine, project, machinery, application, safety requirement, or operating environment.

Certifications
Size and fit
Material specifications
Mine approval requirements

MML may provide general product information, but the final responsibility for product selection, approval, use, and compliance remains with the customer.
17. PPE and Safety Equipment
PPE and safety equipment must be correctly selected, fitted, used, stored, maintained, inspected, and replaced.
MML is not liable for injury, death, damage, loss, downtime, business interruption, or claims caused by:

Incorrect use

18. Lubricants, Oils, Grease, and Chemical-Related Products
The customer is responsible for confirming the correct grade, specification, application, compatibility, storage method, and manufacturer requirement before ordering or using lubricants, oils, grease, or chemical-related products.
MML is not liable for damage, contamination, equipment failure, production loss, downtime, breakdowns, maintenance costs, or claims caused by:
Incorrect product selection
Incorrect application
Incorrect grade or specification
Incorrect storage
Mixing incompatible products
Contaminated containers
Contaminated equipment
Failure to follow manufacturer instructions
Use outside recommended specifications
Failure to follow safety or handling requirements
Safety Data Sheets may be supplied on request where available.
19. Special Orders, Custom Products, Branding, Printing, and Embroidery
Special Order Goods may not be cancelled, returned, exchanged, or refunded unless defective or unless cancellation, return, exchange, or refund is required by applicable law.
MML may require a deposit or full payment before sourcing, ordering, importing, branding, printing, embroidering, altering, or producing Special Order Goods.
Lead times for Special Order Goods are estimates only.
The customer is responsible for checking and approving all artwork, logos, spelling, colours, sizes, layouts, branding positions, embroidery details, print details, and product specifications before production.
Once the customer approves artwork, branding, printing, embroidery, spelling, sizing, or specifications, MML is not responsible for errors, defects, dissatisfaction, or losses arising from approved details.
20. Returns
Returns may be accepted at MML’s discretion and subject to applicable South African law.
To request a return, the customer must contact MML in writing and provide:

Where required by law, MML may provide the legally applicable remedy, which may include repair, replacement, or refund.
MML is not responsible for defects, damage, loss, or failure caused by:

22. Warranties

24. Customer Responsibilities
The customer is responsible for:

Confirming PPE and safety requirements
Confirming lubricant and product specifications
Checking all quotations, invoices, and order confirmations
Inspecting goods on delivery or collection
Reporting problems promptly
Following manufacturer instructions

Complying with all applicable laws, workplace rules, mine rules, health and safety obligations, and industry requirements
25. Limitation of Liability
